Terms of Service — Kismia

Full terms

1. 1. These Terms of Service form a binding agreement between you and Kismia governing your access to and use of the Kismia website and companion chat service.
2. 2. By accessing Kismia you confirm that you have read, understood and agreed to these terms in full.
3. 3. Kismia is strictly limited to adults. You must be at least 18 years old, or the age of majority where you live, whichever is higher.
4. 4. All Kismia companions are fictional characters. They are not real people and no interaction on Kismia constitutes contact with a real individual.
5. 5. Kismia provides conversation and entertainment only, and does not provide medical, psychological, legal, financial or professional advice of any kind.
6. 6. Kismia is not a crisis service. If you are in distress or danger, contact local emergency services or a qualified professional immediately.
7. 7. You are responsible for keeping your account credentials confidential and for all activity carried out through your account.
8. 8. You must provide accurate registration information and keep it up to date while your Kismia account remains active.
9. 9. One person may not operate multiple accounts for the purpose of abusing promotions, trials or usage limits.
10. 10. You may not use Kismia for any unlawful purpose or in breach of any applicable local, national or international law.
11. 11. You may not submit content involving minors, non-consensual acts, violence, self-harm instruction, or the exploitation of any person.
12. 12. You may not attempt to impersonate another person, brand or organisation while using Kismia.
13. 13. You may not use automated systems, scrapers, bots or scripts to access, copy or interfere with the Kismia service.
14. 14. You may not attempt to reverse engineer, decompile or otherwise derive the underlying components of the Kismia service.
15. 15. You may not resell, sublicense, republish or commercially exploit access to Kismia without prior written permission.
16. 16. You may not upload malicious code or take any action intended to disrupt, overload or impair Kismia infrastructure.
17. 17. All Kismia branding, text, imagery, character profiles, design elements and code are protected by intellectual property law.
18. 18. Kismia grants you a personal, limited, non-exclusive, non-transferable and revocable licence to use the service for private purposes.
19. 19. Content you submit remains yours, and you grant Kismia a licence to process it solely to operate and improve the service for you.
20. 20. Companion responses are generated content and may be inaccurate, inconsistent or unsuitable, and should not be relied upon as fact.
21. 21. Kismia may modify, suspend or discontinue any feature of the service at any time, with notice where reasonably practicable.
22. 22. Where paid features are offered, prices, billing intervals and renewal conditions are disclosed clearly before any purchase is completed.
23. 23. Unless required by applicable consumer law, payments for digital features already delivered are non-refundable.
24. 24. You may cancel a recurring plan at any time, and access continues until the end of the paid period already invoiced.
25. 25. Kismia may suspend or terminate accounts that breach these terms, with or without notice depending on the severity of the breach.
26. 26. You may close your Kismia account at any time, and closure ends your licence to use the service immediately.
27. 27. The service is provided on an as-is and as-available basis without warranties of any kind, whether express or implied.
28. 28. To the maximum extent permitted by law, Kismia is not liable for indirect, incidental, special or consequential losses arising from use of the service.
29. 29. You agree to indemnify Kismia against claims arising from your misuse of the service or your breach of these terms.
30. 30. Kismia may update these terms, and continued use of the service after the stated effective date constitutes acceptance of the revised version.
31. 31. If any provision of these terms is held unenforceable, the remaining provisions continue in full force and effect.
32. 32. These terms are governed by the laws applicable at the place of establishment of the Kismia operator, without regard to conflict of law rules.
